  Customer Policy of “IBBI CrackerTM”

 

In order to frame out the services of the “IBBI CrackerTM” to its customers, the Management of ‘IBBI CrackerTM’’ come out with the customer Policy of “IBBI CrackerTM”. The customer policy is very much required for focusing on the key aspects of the services to be provided and in order to streamline the objectives and services of the “IBBI CRACKERTM”. The Management is confident that the adherence to these broad guidelines by “IBBI CRACKERTM” will radically improve its services, also improve the satisfaction to our clients. The Customer policy is hereby formulated by keeping the “IBBI CRACKERTM“ main objective i.e. to help IBBI Valuation Exam aspirants to pass their valuation exam by providing purely optional and supplementary tuition in most efficient manner.

  • Customer Policy

The Customer Policy reads as under –

  1. Privacy:The Privacy of customer information and Data is of utmost importance with us. We use the information provided by the customer only for the purpose of providing the services provided by “IBBI CrackerTM” to the customer. The information shared by the customer with “IBBI CRACKERTM” and its Tutors is used only for the purpose of providing the services required by the customer from “IBBI CRACKERTM”. The Tutors  in turn are also bound by the confidentiality agreement with “IBBI CRACKERTM” (as confidentiality of information and data is one of the most important condition for empanelment with “IBBI CRACKERTM”) and thus the data is fully protected and will not be used your any other purposes.
  2. Services: “IBBI CrackerTM” provides clients with a forum whereby people who need educational consultation to improve their knowledge to appear in Valuation Exams conducted by IBBI [The Insolvency and Bankruptcy Board of India]. “IBBI CrackerTM” has no affiliation with either IBBI [The Insolvency and Bankruptcy Board of India] nor with any of its RVOs. “IBBI CrackerTM” doesn’t promote any IBBI registered RVO. IBBI CrackerTMis a resource for informational purposes only and is intended, but not promised or guaranteed to be correct, complete, and up-to-date. The accuracy, completeness or adequacy of IBBI CrackerTM is not warranted or guaranteed. IBBI CrackerTM further assumes no liability for the interpretation and/or use of the information contained on this website. The owner of this website does not intend links from this site to other websites to be referrals to, endorsements of, or affiliations with the linked entities. Terms and Conditions of Use: If any person intends to use our services, then he affirms that he is an Adult having an age of more than 18 years and is competent to contacts as per Law of this Country. He has fully understood our terms and conditions, obligations, representations, warranties given on our website and in this document.
  4. Quality of Service:By the process of strict empanelment system of Tutors on our Panel, we ensure the services mentioned in our website and this documents only. The Fairness is the first principle towards the quality of services. “IBBI CrackerTM” makes every effort to verify that tutors who teach the subject matter are competent, have passed IBBI Valuation Exam [at least any one area i.e. L&B/ P&M/ Security] and in good standing at the time of registration. However, IBBI CrackerTM cannot track, verify, or monitor the standing of tutors providing their service. Therefore, IBBI CrackerTM makes no representation regarding the status, standing or ability of tutors that are on-boarded with us.
  5. Accountability:“IBBI CrackerTM” is no way will be responsible for the negligence of the tutors. “IBBI CrackerTM” is an internet portal that facilitates communication between tutors and potential users. Any person by taking our service gives us a permission to talk and discuss with many Tutors on his behalf and thereafter, selecting the best suitable Tutor as per his needs for him.
  6. YouTube Membership: Any service availed on YouTube Channel of ”IBBI CrackerTM” shall be solely governed by the Policy and Agreements of YouTube. User to go through policy and other terms and conditions before signing for any YouTube service and /or making payment on the YouTube. Any dispute with respect to YouTube Channel shall be submitted directly to YouTube Channel and “IBBI CrackerTM” shall only be answerable to YouTube only and no other user. Kindly note that any of the YouTube channel membership is subject change of perks without any notice.
  7. Code of Conduct of the Panel Advocates – The “IBBI CRACKERTM” has formulated the following principle guidelines for its Tutors to work on our Panel in order to ensure the best services to you –
  • While working on Panel of “IBBI CRACKERTM” each one of Tutor should possess that he is gentleman first and tutor later.
  • The tutor being the part of the family of “IBBI CrackerTM” should provide its services in the most hassle free manner as possible.
  • “IBBI CrackerTM” is committed towards “Fairness’ in its all dealings. Once the user has paid service fees to “IBBI CrackerTM”, Tutor will not be accept/ expect any type of financial/ non financial favor [s] from the user [s].
  • The Tutor shall deliver his classes as per the schedule designed. In case of medical/ other personal emergencies, the Tutor is advised to timely reach out to “IBBI CrackerTM” to enable “IBBI CrackerTM” alternate arrangement or otherwise reschedule the class/es
  • Tutor shall not recommend/ promote any RVO motivating users to join/ switch any specific RVO.
  • The Tutor should not do any direct calling/dealing with the user unless it is warranted by the court or law and / or permitted by “IBBI CrackerTM”. Asking user to make direct payment Tutor is prohibited.
  • Once a teaching assignment is accepted by the tutor, it should be handled with due care.
  • “IBBI CRACKERTM” hereby agrees to pay the agreed fees to the Tutor. Thus, the tutor should not disclose the agreed fees to be paid by “IBBI CRACKERTM” to him and terms and conditions of empanelment to anyone, including the user. The tutor have to maintain the strict confidentiality in this respect like a trade secret in any commercial transaction. If any incident of disclosure of fees is found, then that may be considered as the sole ground of discontinuation of services of Tutor by “IBBI CrackerTM”.
  • “IBBI CrackerTM” is in no way will be responsible for any type of negligence of the Tutor.
  1. Billing for your Services: In order to avail our services, you have to choose any of the services available on our website https://ibbicracker.co.in; and pay accordingly. To pay the charges for a Service, you will be asked to provide a payment method at the time you sign up for that Service. By providing with a payment method, you (i) represent that you are authorised to use the payment method you provided and that any payment information you provide is true and accurate; (ii) authorise “IBBI CRACKERTM” to charge you for the Services availed by you; and (iii) authorise “IBBI CRACKERTM” to charge you for any paid feature of the Services you choose to sign up for or use while these Terms are in force. We may bill you (a) in advance; (b) at the time of purchase; (c) shortly after purchase or (d) on a recurring basis for subscription Services. Also, we may charge you up to the amount you have approved, and we will notify you in advance of any change in the amount to be charged for recurring subscription Services. We may bill you at the same time for more than one of your prior billing periods for amounts that haven’t previously been processed.
  2. Billing of YouTube Channel Membership: Service availed on YouTube Channel of ”IBBI CrackerTM” shall be solely billed by YouTube only. “IBBI CrackerTM” is not responsible for any invoicing or any dispute related to content, billing, invoicing, cancellation, refund, non payment, disputed transaction etc and the user shall contact YouTube directly. “IBBI CrackerTM” shall only be answerable to YouTube only and no other user. Kindly note that any of the YouTube channel membership is subject change of perks without any notice.
  3. Online Invoicing and Errors.For all Services [excluding services availed through YouTube] “IBBI CRACKERTM” will provide you with an online billing invoice on the “IBBI CRACKERTM” account management page, where you can view and print your invoice, by signing into your account at ibbicracker.co.in. This is the only billing invoice that we provide. If we make an error on your bill, you must tell us within 60-days after the error first appears on your bill. We will then promptly investigate the charge. If you do not tell us within that time, you release us from all liability and claims of loss resulting from the error and we won’t be required to correct the error or provide a refund, unless otherwise required by law. If “IBBI CRACKERTM” has identified a billing error, we will correct that error within 60 days. This policy does not affect any statutory rights that may apply.
  4. Refund Policy:WE hereby ensure that in case of your first purchase of our service, you have the option to claim the refund within 7 days of the purchase or before you start consuming/ availing the purchased service, whichever is earlier. If you are not satisfied with our services, then we will refund your money [after deduction of out-of-pocket/ misc. charges like bank/payment gateway charges etc already incurred or to be incurred in relation to your purchase/ refund] received without any interest within 7 days of your purchase OR before you start consuming/ availing the purchased service [also called due date for refund]. After said date for refund, you are not entitled to claim any refund. That Unless otherwise provided by law or the terms of a particular Service offer, all purchases are final and non-refundable after 7 days of its purchase OR immediately after you start consuming / availing the services purchased. If you believe that IBBI CRACKERTM has charged you in error, you must contact us within 60 days of such charge. No refunds will be given for any charges more than 60 days old, unless otherwise required by law. We reserve the right to issue refunds or credits at our sole discretion unless otherwise required by law. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. This refund policy does not affect any statutory rights that may apply.

Any refund related to YouTube Channel, shall be solely at discretion and as per policy and terms and conditions of the YouTube only. “IBBI CrackerTM” has no obligation to answer any query related to any question related to money paid to YouTube or service availed from the YouTube by user.

  1. Cancelling the Services: You may cancel the services at any time of purchase. However, no refund will be made after 7 days of first purchase or the date after you start availing/ consuming the purchased services, whichever is earlier.

If we confirm your request for refund, subject to the terms and conditions mentioned herein or elsewhere, we will send you an e-mail seeking the details required to refund the amount which may include your Bank Account details such as the account number and the IFS code of the branch in question. Kindly note that it will take us a minimum of about 48-72 working hours from the receipt of all such information to process the refund and initiate the transfer.

Any cancellation request related to YouTube Channel, shall be solely at discretion and as per policy and terms and conditions of the YouTube only. “IBBI CrackerTM” has no obligation to answer any query related to any question related to money paid to YouTube or service availed from the YouTube by user.

  1. Trial-Period Offers:If you are taking part in any trial-period offer, you may be required to cancel the trial Service(s) within the timeframe communicated to you when you accepted the offer in order to avoid being charged to continue the Service(s) at the end of the trial period.

Trial Period offers, if any, availed from YouTube, shall be solely at discretion and as per policy and terms and conditions of the YouTube only. “IBBI CrackerTM” has no obligation to answer any query related to any question related to money paid to YouTube or service availed from the YouTube by user.

  1. Promotional Offers.From time to time, “IBBI CRACKERTM” may offer Services for free for a trial period. “IBBI CRACKERTM” reserves the right to charge you for such Services (at the normal rate) if “IBBI CRACKERTM” determines (in its reasonable discretion) that you are abusing the terms of the offer.

Promotional Period offers, if any, availed from YouTube, shall be solely at discretion and as per policy and terms and conditions of the YouTube only. “IBBI CrackerTM” has no obligation to answer any query related to any question related to money paid to YouTube or service availed from the YouTube by user.

  1. Price Changes.We may change the price of the Services at any time, we will notify you by email, or other reasonable manner, at least 15 days before the price change. If you do not agree to the price change, you must cancel and stop using the Services before the price change takes effect. If there is a fixed term and price for your Service offer, that price will remain in force for the fixed term.

Price changes of YouTube channel shall be solely at discretion and as per policy and terms and conditions of the YouTube only. User has to directly contact to YouTube for any question/ query related to price changes. “IBBI CrackerTM” has no obligation to answer any query related to any question related to money paid to YouTube or service availed from the YouTube by user.

  1. Payments to You.If we owe you a payment, then you agree to timely and accurately provide us with any information we need to get that payment to you. Subject to applicable law, you are responsible for any taxes and charges you may incur as a result of this payment to you. You must also comply with any other conditions we place on your right to any payment. If you receive a payment in error, we may reverse or require return of the payment. You agree to cooperate with us in our efforts to do this. We may also reduce the payment to you without notice to adjust it for any previous over-payment.
  2. Gift Cards.Redemption and use of gift cards are governed by the terms and conditions provided by the “IBBI CRACKERTM” management on time to time basis and will be specified with the gift card so provided.
  3. Bank Account Payment Method.You may register an eligible bank account with your “IBBI CRACKERTM” account to use it as a payment method. Eligible bank accounts include accounts held at a financial institution capable of receiving direct debit entries (e.g. Indian States-based financial institution that supports automated clearing house (“ACH“) entries. Terms you agreed to when adding your bank account as a payment method in your “IBBI CRACKERTM” account (e.g., the “mandate” in the case of SEPA) also apply. You represent and warrant that your registered bank account is held in your name or you are authorised to register and use this bank account as a payment method. By registering or selecting your bank account as your payment method, you authorise “IBBI CRACKERTM” (or its agent) to initiate one or more debits for the total amount of your purchase or subscription charge (in accordance with the terms of your subscription service) from your bank account (and, if necessary, initiate one or more credits to your bank account to correct errors, issue a refund or similar purpose), and you authorise the financial institution that holds your bank account to deduct such debits or accept such credits. You understand that this authorisation will remain in full force and effect until you remove your bank account information from your “IBBI CRACKERTM” account. Laws applicable in India will be applicable for any fraudulent, erroneous or unauthorised transactions from your bank account. By registering or selecting a bank account as your payment method, you acknowledge that you have read, understand and agree to these Terms.
  4. Law & Location for Resolving Disputes. The laws of the as applicable in India will be applicable in case of any dispute arising therein. The Jurisdiction of Courts in Kurukshetra, Haryana will be applicable in case of any dispute.
  5. Change in the Customer Policy:The Customer Policy is thus approved by the Management and any change in the policy can be made only after the approval of Management of “IBBI CRACKERTM”.
